The platform allows clients, including labels, artists, managers, radio professionals, and other authorized users, to submit songs for research. Participating listeners, also known as predictors, may listen to songs and provide ratings or feedback based on their music preferences.

2. User Accounts

Certain areas of The Hit Predictor require an account. You agree to provide accurate information when creating or updating your account and to keep your login information secure.

You are responsible for activity that occurs under your account. If you believe your account has been accessed without authorization, you should contact The Hit Predictor as soon as possible.

3. Predictor Participation

Predictors may be invited or allowed to participate in music research by listening to songs, selecting music preferences, and submitting ratings or feedback. Predictor participation should be honest, independent, and based on the predictor’s actual opinion of the song or content reviewed.

The Hit Predictor may limit, suspend, or remove accounts that appear to submit fraudulent, automated, abusive, or intentionally misleading ratings or activity.

4. Client Use of the Platform

Clients may use The Hit Predictor to submit songs, create projects, request research, and review available reports. Clients are responsible for ensuring they have the necessary rights, permissions, and authority to upload or submit any music, audio, artwork, names, trademarks, or related materials to the platform.

The Hit Predictor may reject, remove, or disable content that appears to violate these Terms, infringe another party’s rights, contain unlawful material, or create legal or operational risk.

5. Music, Audio, and Uploaded Content

By uploading or submitting music or other content to The Hit Predictor, you represent that you have the rights or authorization needed to submit that content for research, playback, storage, processing, and reporting through the platform.

You retain ownership of content you submit, but you grant The Hit Predictor a limited right to use, store, process, stream, analyze, and display that content as needed to provide the requested services, operate the platform, and generate research results or reports.

6. Research Results and Reports

The Hit Predictor provides audience feedback, song ratings, summaries, and research reports based on available platform activity. Research results are intended to provide insight and guidance. They do not guarantee commercial success, radio airplay, playlist placement, sales, streaming performance, chart performance, or any specific business outcome.

Clients are responsible for how they interpret and use research results. The Hit Predictor is not responsible for business decisions made based on reports, scores, summaries, or platform data.

7. Payments, Billing, and Refunds

Certain services may require payment. Pricing, project fees, song testing fees, subscription fees, or promotional offers may be displayed on the website, invoice, proposal, or other written communication from The Hit Predictor.

Unless otherwise stated in writing, payments are due before services are activated or reports are delivered. Refunds, credits, or adjustments may be reviewed on a case-by-case basis at the discretion of The Hit Predictor LLC.

8. Acceptable Use

You agree not to use The Hit Predictor to:

Upload content you do not have the right to use
Submit false, misleading, fraudulent, or abusive information
Attempt to manipulate ratings, votes, or research results

11. SMS Terms & Conditions

By opting in to SMS messages from The Hit Predictor LLC, you agree to receive account and platform-related text messages from The Hit Predictor.

These messages may include verification codes, login or security alerts, voting reminders, song research notifications, project updates, and client report or upload notices.

Message frequency may vary based on account activity, voting opportunities, project activity, and client report availability. Standard message and data rates may apply.

You can cancel SMS messaging at any time by replying STOP. After you send STOP, we may send one confirmation message to confirm that you have been unsubscribed. After that, you will no longer receive SMS messages from The Hit Predictor unless you opt in again.

SMS consent is optional and is not required to create an account or use The Hit Predictor services.

Mobile carriers are not liable for delayed or undelivered messages.
